Online Program Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the website, online store, online programs, and community (“Materials” or “Program”) provided by True Potential Training Pty Ltd (“True Potential Training”, “we”, “our”, or “us”). By accessing our website, purchasing, or using our Program, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing our website, online store, Program, or community, you agree to these Terms without modification.
We may update or modify these Terms at any time at our discretion. Your continued use constitutes acceptance of any changes.
If you do not agree to these Terms, you must not access the website or use the Program.
2. Eligibility & Account Responsibility
You must be 18 years or older or have parental/guardian consent to participate.
You agree to provide accurate and complete registration information and maintain the confidentiality of your account credentials.
You are responsible for all activity conducted through your account. Any unauthorised use must be reported immediately.
3. Medical Disclaimer & Assumption of Risk
The Program is self-directed and may involve high-intensity physical activity, including pull-ups, bodyweight exercises and weighted movements.
You acknowledge the inherent risks of injury, including but not limited to muscle soreness, strains, fainting, abnormal blood pressure, heart attack, or death.
You represent and warrant that you are physically fit to participate and have consulted a qualified healthcare professional if you have any medical conditions, injuries, or concerns.
You acknowledge that the Program may not be suitable if you are pregnant, have chronic medical conditions, recent surgery, or any other health concern. You must seek clearance from a healthcare professional before participating.
You must stop immediately if you experience pain, dizziness, nausea, or discomfort.
Participation is entirely at your own risk. True Potential Training is not liable for any injury, loss, or health complication arising from your participation.
4. Intellectual Property & Use of Program Content
All Program materials, including videos, guides, PDFs, images, graphics, and code, are protected by copyright, trademark, and other intellectual property laws.
You may use the Program for your personal, non-commercial use only.
You may not:
Reproduce, record, copy, distribute, or share Program content in any form;
Upload or post Program content to any third-party website or social media;
Sell, license, or provide Program access to others.
Program content may be updated, modified, or discontinued at any time without notice. True Potential Training is not liable for any consequences resulting from such changes.
Any violation of these terms may result in immediate termination of access and potential legal action.
5. Community Conduct
If you participate in the Program’s community section, forum, or social features, you agree to:
Engage respectfully with other users;
Avoid posting offensive, defamatory, discriminatory, or illegal content;
Not share Program content, account credentials, or copyrighted materials.
2. True Potential Training reserves the right to remove or restrict access to users who violate these rules without notice.

We do not endorse or guarantee the content, products, or services on third-party sites.

8. Availability & Technical Disclaimer
We make reasonable efforts to ensure the Program and website are available, but we do not guarantee uninterrupted access.
We are not liable for interruptions, errors, or technical issues caused by third parties or your equipment.
You agree to not interfere with website security, including hacking or tampering.
9. Refunds & Access
Due to the digital nature of the Program, all sales are non-refundable once access credentials are provided.
If technical issues prevent access, we will make reasonable efforts to restore it but are not liable for temporary interruptions.
The Program is available to residents nationwide across Australia. By purchasing, you represent that you reside in Australia and are legally eligible to participate.
10. Release of Liability & Indemnity
By using the Program, you release, waive, and discharge True Potential Training and its affiliates, officers, employees, and contractors (“Releasees”) from any liability for injury, loss, or damages, including those caused by negligence.
You agree to indemnify and hold harmless the Releasees from any claims by third parties resulting from your participation.
11. Limitation of Liability
To the extent permitted by law, True Potential Training’s liability is strictly limited to the cost of resupplying the Program.
We are not liable for indirect, incidental, or consequential damages arising from your use of the Program or website.
12. Privacy & Data Security
We store your account and personal information securely in accordance with our Privacy Policy.
While we take reasonable steps to protect your data, we cannot guarantee complete security of information transmitted via the internet.
You accept that you provide information at your own risk until received by us.
13. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL), which applies nationwide.
Your statutory rights under the ACL, including guarantees regarding acceptable quality and fit for purpose, apply regardless of your state or territory of residence.
14. Terms of Sale & Delivery
“Goods” or “Services” refers to online programs or materials purchased through the website.
Prices exclude GST unless stated.
Delivery refers to access credentials for digital content, which are provided immediately or within a stated period.
Cancellation is not permitted once access has been granted.
15. Dispute Resolution
In the event of a dispute, you agree to first attempt good faith mediation before pursuing legal action.
If mediation fails, disputes will be resolved in the courts of Australia, subject to applicable law. Nothing in these Terms limits your statutory rights to bring proceedings in your state or territory of residence.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of Australia, including the Australian Consumer Law.
Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Tasmania for the resolution of disputes.
If any part of these Terms is deemed unenforceable, it will be severed, and the remainder will remain in effect.
